Virtually every home cannot be placed on the market for sale until such time as a Home Information Pack has been commissioned.

Do not be fooled by offers of “free” HIPS. Sellers are bound to pay for them either directly or indirectly. Solicitors are best able to prepare HIPS. The pack is a legal pack. Solicitors understand the documents which go into Hips and can interpret the information they reveal. The pack has been designed to provide a seamless HIP – to – conveyancing process.

What will I get for my money?

In a practical sense you will gain the opportunity to sell your house. Subject to limited exceptions, without a pack having been commissioned you cannot even place your property on the market for sale. 

The pack will contain among other material:-
 

1. A Sales Statement containing core information about the  transaction – whether the property is freehold or leasehold and so on.

2. Official copies of the entries on the register of title and title plan – or, if the title is not registered, sufficient unregistered title documentation to evidence the seller’s title to sell the property, including an Index Map Search. A solicitor considering the copy entries will be in a position to advise upon whether other documents which are perhaps not required to be produced with a Hip ought to be made available to prospective purchasers in order to clarify in advance the position on covenants affecting the property and so on.

3. A local search (revealing the planning history of the property, road proposals etc).

4. A drainage search (showing in many cases the routes of the drains and water pipes serving the property).

5. An energy performance certificate rating the energy efficiency and environmental impact of the property.

6. Where the property is leasehold an official copy of the Lease will be included.
